BrandShield Navigating the Evolving TLD Landscape

Navigating Brand Infringement in the Expanding World of Top-Level Domains

In today’s digital landscape, brands face an increasingly complex challenge: managing brand infringement across a vast and ever-growing number of top-level domain names (TLDs). The introduction of hundreds of new TLDs, such as .online, .shop, .tech, and many more, has created a wider playing field for potential infringers, making it more difficult for brands to monitor and protect their intellectual property.

Traditional methods of brand protection, such as simply registering every conceivable domain name variation, are no longer practical or cost-effective. Instead, brands need a strategic, intelligent approach to identify and address the infringements that pose the greatest risk to their brand reputation, customer trust, and bottom line. Brand protection company BrandShield, a company with its roots deeply embedded in the domain registration industry, advocates for a common-sense strategy, focusing on the infringements that truly matter.

The Evolution of Brand Protection: From Registrar to Brand Monitoring Specialist

The story of BrandShield begins in 2000 with Yoav Keren and his colleagues, who launched Domain The Net, an Israel-based registrar reseller. Keren, who also served as a senior advisor in the Israeli government, recognized an untapped opportunity in the domain name market. Their initial research highlighted a significant gap in the availability of comprehensive domain management services.

The following year, the partners secured accreditation as an ICANN registrar and began developing their domain management capabilities. Keren observed early on, around 2001, a growing need for intelligent brand monitoring and analysis services. This insight led to the creation of a dedicated domain management department within Domain The Net in 2003, marking the genesis of what would eventually become BrandShield.

“The need for online brand protection solutions has evolved dramatically over the years,” Keren explains. “We identified the initial challenges back in 2001, but the situation has grown increasingly complex.” The increasing sophistication of online activities made simple monitoring insufficient. New techniques for hiding illicit activity and the sheer volume of new domain names made the job of protecting a brand extremely difficult.

The introduction of ICANN’s new generic Top-Level Domain (gTLD) program after a decade of gradual evolution signaled a paradigm shift. Keren and his team realized that the traditional methods of brand protection were no longer sufficient. This realization triggered a period of intense development, leading to the establishment and spin-off of BrandShield in 2013.

BrandShield’s Deep Web Crawling and Natural Language Processing

BrandShield differentiates itself through its advanced technology, particularly its ability to crawl the deep web – areas not indexed by traditional search engines like Google. This includes content behind paywalls and within specific websites. The BrandShield application employs sophisticated natural language processing (NLP) algorithms to analyze, assess, and report potential threats to a brand. This comprehensive approach allows for the identification of infringements that would otherwise go unnoticed.

“Google’s searches cover only a small fraction of the web, approximately four percent,” Keren notes. BrandShield’s searches cover a much larger area, including content in English and various Asian scripts, providing a more comprehensive view of the online landscape. This ability to look deeper into the internet is a key advantage in identifying threats to a brand.

Customized Threat Prioritization for Brands of All Sizes

BrandShield understands that a brand’s identity and intellectual property are valuable assets, regardless of the company’s size. The company collaborates with clients to create automated, customized alert levels, ensuring that resources are focused on the most critical threats. This tailored approach allows even small businesses to benefit from BrandShield’s services.

“Sometimes, smaller companies are the ones experiencing the most abuse,” Keren points out. He cites the example of a small business that patented and sold its product on Amazon for less than a year. Using BrandShield, the company discovered counterfeit versions of its product being sold worldwide. This example highlights the potential damage that even a small amount of counterfeiting can cause and the importance of being vigilant.

The BrandShield engine goes beyond simply identifying potential threats. It performs a detailed analysis to determine the severity and impact of each infringement. This analysis considers various data points, including the ranking of the infringing website or content. The engine then ranks threats according to a pre-set prioritization algorithm, customized based on the brand manager’s preferences. This allows for the efficient allocation of resources, focusing on the infringements that pose the greatest risk.

“When you encounter thousands of instances of infringement, you need to prioritize and focus on the most damaging ones,” Keren emphasizes. Without proper prioritization, a company could spend valuable resources chasing minor issues while more significant threats remain unaddressed.

The Power of Machine Learning in Brand Protection

BrandShield leverages the power of machine learning to continuously improve its threat detection and prioritization capabilities. The system learns from the brand manager’s actions, adapting to the brand’s specific preferences and making recommendations based on past decisions. This ensures that the brand protection strategy remains aligned with the evolving needs of the business.

Keren highlights that clients appreciate the increased visibility they gain, allowing them to see patterns and networks of abuse that were previously hidden. The ability to prioritize threats effectively further enhances the value of the BrandShield platform.

A Strategic Approach to Brand Protection: Manage, Monitor, and Act

BrandShield’s approach to brand protection is rooted in a practical philosophy: manage a reasonable portfolio of critical assets, continuously monitor the broader landscape, and take decisive action when significant threats arise. This strategy applies to trademarks, copyrights, brand collateral, counterfeiting, and other forms of brand abuse.

“When something truly damaging occurs, take action,” Keren advises. “This is the core of our strategy, and it sets us apart from many others in the market.” Rather than attempting to eliminate every possible infringement, the focus is on mitigating the most significant risks.

In the past, some brands have focused heavily on pursuing domain registrants who register domain names that are similar or identical to their trademarks. This often involved expending significant time and resources to force the registrant to relinquish the domain name. Keren argues that this approach is often misguided.

“Search the web for your domain name or registered trademark. You might find a parked page or pay-per-click advertising. Does that really matter? If it has no traffic, should you really care? Why waste money and time on taking it down? Why go through the trouble of filing a UDRP or URS? There might be thousands of other websites that don’t use a relevant domain name but have significant traffic and are trading on your brand’s reputation. These are the ones you should be pursuing.”

A 21st-Century Approach to Brand Protection

While BrandShield primarily works with companies that align with its strategic approach, the company also assists those who prefer a more traditional approach to brand protection. However, Keren consistently encourages clients to prioritize their efforts, focusing on the infringements that pose the greatest potential for damage.

“I understand that our strategy is different,” he acknowledges. “But I believe that if you want to effectively fight a 21st-century war against brand infringement, you need to utilize 21st-century tools and strategies.” The BrandShield platform offers the capabilities and insights needed to navigate the complexities of the modern digital landscape and protect brand equity effectively.
