A UDRP Complainant turned down an inexpensive settlement offer, only to lose the case.
A Fresh York-area business owner has a reason to kick himself following turning down a settlement offer in a cybersquatting dispute.
Kyle Kantor of Good Ground Hospitality, LLC, which holds a trademark for Ovenly, filed a dispute against the domain ovenly.com.
Following Kantor filed the dispute, the domain investor who owns the domain offered to transfer it for the price it paid to acquire it in an expired domain auction in 2024: $709.
Kantor declined and offered to pay only $100.
With a settlement off the table, the three-person panel proceeded to decide the case…in the domain owner’s favor.
The panel agreed that the trademark was pretty weak and that the name Ovenly is used by many different firms. It found that the Complainant didn’t show that the registrant lacked rights or legitimate interests in the domain name.
It will likely cost a lot more than $709 to get the domain now.
Ankur Raheja of Cylaw Solutions represented the domain name owner.
