Verisign and XYZ duke it out in court — Listen to

Court of Appeals listens to arguments in false advertising case.

Verisign and XYZ presented oral arguments in front of the Fourth Circuit Court of Appeals the prior week in Verisign’s false advertising lawsuit against the firm that runs .XYZ.

Lisa Blatt argued for Verisign and Derek Newman argued for XYZ.

You can listen to the arguments here.

At least one judge seemed unimpressed with Blatt’s approach, interrupting her within the first couple of minutes to suggest she argue differently. Blatt stated it was the first time she had argued a summary judgment appeal.

One interesting part was when Judge Pamela A. Harris asked if Verisign was making a big deal out of nothing when it came to XYZ touting NPR naming it the next .com.

8:xx Harris: I looked at the blog post and it links, it states we implore you to listen to the whole interview [and provides a link]…they’re obviously not hiding anything, they want the people who read the blog to listen to the full interview which would give them the literal thing that was stated by NPR…Isn’t this making kind of a big deal out of a little [interuppted].

The court will make its decision sometime between now and June, but is known for resolving appeals faster than most courts of appeal.
