Poop scooping firm files lawsuit following reverse domain hijacking finding

Scoop Soldiers might have better luck in court than it did with UDRP.

A poop-scooping franchisor has filed a federal lawsuit in a domain name dispute.

Scoop Soldiers Service Firm, LLC filed the lawsuit (pdf) in U.S. District Court against Top Paw Distributing LLC over the domain name ScoopSoldier .com (singular).

The lawsuit comes following Scoops Soldiers twice failed to get the domain name through the Uniform Domain Name Dispute Resolution Policy (UDRP). In the second dispute, the panel found it was a case of reverse domain name hijacking since Scoop Soldiers refiled a case without justification.

Still, Scoop Soldiers might have a good case in the eyes of the court. As I wrote when covering the reverse domain name hijacking case, a court case can look further into Top Paw’s motives for registering the domain name. Although the first UDRP panel thought it was just a coincidence that Top Paw registered the name, discovery might show otherwise.
