Two firms that say GoDaddy unfairly clawed back domains they won at expired domain auctions have refiled a lawsuit following a judge dismissed their first one.

Crisby Studio AB bought the domain name calor.com at GoDaddy Auctions, and Prime Loyalty LLC bought butane.com. Calor Gas Ltd of the United Kingdom previously owned both domains.

GoDaddy clawed the domains back regarding two months following they were sold, stating that the domains were auctioned in error. By then, the firms had by now invested in the planned sites for the domains and entered into partnerships.

Crisby Studio filed the original lawsuit in August, and Prime Loyalty joined in later. The judge dismissed the case in November over subject matter jurisdiction.

The refiled case (pdf) attempts to address the jurisdiction issue. But since the lawsuit was filed, GoDaddy has introduced a lot of defenses that the plaintiffs will also have to overcome.
