Name hijacking over ActiveOwnership.com — Reverse domain

Firm filed UDRP following failing to purchase domain name.

A Luxembourg firm has been found to have engaged in reverse domain name hijacking over the domain name ActiveOwnership.com.
Active Ownership Capital S.à.rl filed the cybersquatting case with World Intellectual Property Organization. The firm uses the Luxembourg country code domain name ActiveOwnership.lu, so it’s not surprising that it wants to own the .com equivalent.
The firm reached out to the domain owner and made offers of up to €6,000. It then filed the UDRP following the purchase attempts failed.
Active Capital started doing business in 2015 and the domain name was registered in 2010. This means that the domain owner could not have registered the domain name in bad faith the target the non-existent Complainant.
The panel found that Active Ownership Capital S.à.rl filed the complaint in abuse of the UDRP since it did not address the obvious issue of the registration dates and since it mischaracterized actions of the domain owner.
